Wedding Cakes: TERMS AND CONDITIONS CONTRACT

Dear Customer

1. Entire Agreement: This agreement contains the entire understanding between Cakeland of The Lakes and The Wedding Client ( Bride; Groom and Civil Partners) This contract replaces all prior agreements between the Parties. All amendments to this agreement must be done in writing and must be signed and received within 3 months of the event date.

2. Pre-Event Consultation: The Parties agree to a free 1 hour preliminary consultation, either in person, by telephone or by email prior to the event date in order to ascertain and confirm the design details and the price to be charged. Subsequent consultation will be charged at a rate of £15 per hour. The consultation must take place 90 days before the event at the latest.

3. Wedding Cake Quote:  The Wedding Client will receive a quote for all items discussed. The quote will show costs pertaining to the cake but would be exclusive of delivery unless the exact distance is known and charges agreed at the time of the quote. Each design is individually calculated based upon the cake content and skilled time element involved in creating each design to provide quotes as accurate as possible.

4. Booking Fee: A 20% deposit of the total costs is to be paid within 10 days of the consultation and required to secure the wedding date. The Booking Fee will be applied to the contracted wedding cake and will be deducted from the final invoice. Failure to pay the Booking Fee within 10 days the booking will be deemed cancelled and the date will be made available to the general public.

5. Reservation: Cakeland of The Lakes will reserve the wedding date upon receipt of the booking fee. The booking fee is non-refundable under any circumstances, including but not limited to the wedding date changed or the wedding cancelled for any reason, in the acts of God, fire, road blockage, strike and or extreme weather.

6. Hiring of Additional Items: In the event that additional items are being hired from Cakeland of The Lakes, such as cake stands, bases and separators, clients are required to complete a hire form and submit a security deposit. Deposits are payable by personal cheque only. This fee must not be included with the booking fee or invoice payment. The deposit cheque will be banked for clearance and we reserve the right to take deductions to replace damaged or loss of stock and we will invoice the Wedding Client who is held responsible for the safe return of all the hired items for any additional costs. Any additional payment required must be settled within 10 days after the wedding date. In the case that there are no damages or loss of the hired items, Cakeland of The Lakes will return the cheque deposit.

7. Transport Boxes: Transport Boxes are custom made to contain the height, width and weight of the wedding cake and cost £22 minimum and are required without exemption for all Wedding Cake orders being collected by the Wedding Client or their chosen courier and not being delivered by Cakeland of The Lakes.

8. Balance of Payment: The Balance of Payment is due 28 days prior to the wedding date. It is solely the Wedding Client’s responsibility to ensure the settlement of the final payment within the agreed time. Cakeland of The Lakes will not issue a reminder for this. Late payment fees will be applied to the final balance. Failure to pay the final balance within the agreed time limit will render the booking to have been cancelled.

9. Delivery: Cakeland of The Lakes will provide delivery for all ordered items. Cakeland of The Lakes will not be responsible for incorrect delivery times, dates or locations provided to us by the Wedding Client. Delivery charges vary dependent on the distance and mileage to the location of delivery.

10. Set-Up Time: Cakeland of The Lakes require at least an hour and a half setting up all ordered items, to ensure that there is adequate amount of time to arrange the cake prior to the arrival of the guests. Cakeland of The Lakes require the Wedding Client to ensure that a set up table appropriate for the cake is available at the venue to avoid delay to set-ups.

11. Delivery Confirmation: In the case that the Wedding Client may not be available during the delivery, they must ensure to delegate a responsible person to meet the Cake Designer at the reception, to sign a confirmation of receipt of the cake and items being delivered, to ensure that all items are accounted for and are all in good order.

12. Completion Schedule: All items ordered will be delivered at the date and time agreed upon between The Wedding Client and Cakeland of The Lakes. Cakeland of The Lakes will not be held responsible for any changes not made known to us.

13. Returning Additional Items: All additional items hired from Cakeland of The Lakes must be returned in their original form at the time of delivery within five days of the wedding date by The Wedding Client or their delegated responsible person.

14. Penalty, Fees and Charges: There will be £20.00 per day late payment fee for any unreturned hired items within the agreed return timescale.

15. Method of Payment: Payment maybe made by cash, cheque or direct bank transfer. (a £4 in every £100 charge will be levied for this services)  Cakeland of The Lakes will not provide any services without the Wedding Client’s financial institution’s approval of payment.

16. Right of Withdrawal: Discovery of new information, changes to agreed circumstances or other factors which could circumvent its policies may result in its withdrawal. Non-cooperation, changes in locations, times, dates, facilities availability, missed appointments, non confirmation of quote acceptance and late payments are examples of contributing factors. Should Cakeland of The Lakes initiate the withdrawal, all fees will be returned, except for the Booking Fee as well as fair market value of all the products/services already provided. 17. Cancelation: Cakeland of The Lakes offers bespoke service which limits the number of booking we can take in any given week. Should the Wedding Client cancel the order within 3 months of the wedding date, it will be unlikely that the cancelled space will be filled. Under the circumstances of cancelation, the following charges therefore will apply. Cancelation must be done in writing.

    1 month or less – 100% of Full Cake Cost

    1month to 3 months – 50% of Full Cake Cost

    3 months or more – Loss of Booking Fee

18. Model Release: The Wedding Client hereby assigns and grants Cakeland of The Lakes and its legal representatives the irrevocable and unrestricted right to use and publish photographs of The Wedding Client or photographs in which they may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Wedding Client hereby releases Cakeland of The Lakes and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that Cakeland of The Lakes may display and use photographs taken for advertising, display on website and internet promotion, photographic competitions, public display such as in trade shows, bridal shows, cake industry publications, studio display, television advertising and any other purposes deemed proper by Cakeland of The Lakes.

19. Limit of Liability: In the unlikely event of medical, natural or other emergencies, it may necessitate Cakeland of The Lakes to retain an alternative Cake Designer.  Cakeland of The Lakes will make every effort to secure a replacement Cake Designer capable, able and willing to provide similar products and services as chosen in this contract at the same or similar tariff. If such situation occur and a suitable proxy Cake Designer is not found, responsibility and liability is limited to the return of all payments received for the event.

20. Miscellaneous: Cakeland of The Lakes will take the utmost cake with respect to design, handling, transportation and delivery of your cake. The limit of Liability shall not exceed the contract price stated in this contract. Cakeland of The Lakes cannot be held liable for emotional, physical or financial distress due to any unforeseen circumstances. Items outside this contract are the sole responsibility and liability of The Wedding Client.

21. Non-Guarantee: Although every possible care will be taken during the delivery and set up of the wedding cake, Cakeland of The Lakes cannot be held responsible for any subsequent damage to the cake once it is delivered. All responsibilities become the Wedding Client’s liability. The same policy applies should The Wedding Client chose to collect the cake or use a third party to collect the cake from Cakeland of The Lakes.

22. Performance: The performance of this contract on behalf of Cakeland of The Lakes shall be dependent upon acts of God, weather and or road conditions, flood, fire, warfare, government laws and regulations, electrical failure, strikes by suppliers/staff, health and or conditions beyond its control.

23. Price Amendments: Prices are valid 1st January to 31st December every year and are subject to changes without prior notice.

24. Refunds: Refunds are given only in exceptional circumstance as deemed appropriate by Cakeland of The Lakes.

25. Allergies: Cakeland of The Lakes cannot be held responsible for nut allergies for The Wedding Client or their parties. All cakes COULD contain traces of nut. It’s the responsibility of The Wedding Client to inform their guests that traces of nut could be present in the cake.


Other Cakes: Terms & Conditions:

1. Booking Timescale:
CeLebration cakes must be booked a minimum of 2 weeks in advance due to the specialist design       and often complex and intricate details.

2. Quote: 
Quotes are usually given at the time of enquiry for all items discussed. All quotes exclude delivery but this could be arranged. Each design will be individually calculated to provide our clients the most accurate quote based on the cake content and skilled time element involved in creating each design.

3. Booking Fee: A Booking Fee of £50 is required to be paid upon the order being placed to secure the celebration date. The Booking Fee will be deducted from the final total and is non-refundable, regardless of any changes of the circumstances, including acts of God, fire, strikes, road blockage, government law, warfare, and or extreme weather condition.

4. Transport Boxes: Transport Boxes cost a minimum of £15.00 and are specially made to contain heavy and tall cakes.  These are required without exemption for all Celebration Cakes of 3 tiers or more being collected by The Client and not being delivered by Cakeland of The Lakes.

5. Balance of Payment. The Balance of Payment made by Cheque or Bank Transfer is due 2 weeks prior to the celebration date or upon the order being placed if this is less than 2 weeks and 7 days prior to collection/delivery for cash payment.

6. Method of Payment: Payment can be made by Cash, Cheque or Bank Transfer (bank charges rate applies for none cash payment).

7. Cancelation: Cakeland of The Lakes offers a bespoke service and is therefore limited to how many bookings are taken for any given week. Cancellation made within a week of the celebration date will be charged at 100% of the Full Cake Cost. Cancellation must be done in writing.

8. Model Release. The Client hereby assigns and grants Cakeland of The Lakes and its legal representatives the irrevocable and unrestricted right to use and publish photographs of The Client and their Cake or photographs in which they may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same.  The Client hereby releases Cakeland of The Lakes and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that Cakeland of The Lakes may display and use the photographs taken for advertising, display, website and internet promotion, photographic competitions, public display such as in trade shows, cake industry publications, studio display, television advertising, magazine advertising and any other purpose deemed appropriate by Cakeland of The Lakes.

9. Limit of Liability: In the very unlikely event of severe medical, natural or other emergencies, it may be necessary to retain an alternative Cake Designer to create The Client’s cake. Cakeland of The Lakes will make every effort to secure a replacement cake designer able and willing to provide similar products and services as chosen in this contract at the same/similar tariff. If such circumstances occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event.

10. Miscellaneous: Cakeland of The Lakes will take utmost care with you cake order but the limit of liability shall not exceed the contract price stated in this contract. Cakeland of The Lakes is only held liable for the items and services listed in this contract. Cakeland of The Lakes cannot be held liable for emotional, physical or financial distress due to any unforeseen circumstances that may present themselves. Items outside of this contract are the responsibility and liability of The Client.

11. Non-Guarantee: If delivery is required by The Client, every possible care will be taken with said delivery and set up of the celebration cake. Once delivered, the cake becomes the responsibility of The Client. Cakeland of The Lakes cannot be held responsible for any subsequent damage to the cake once they are in the care of The Client.

12. Performance: The performance of this contract on behalf of Cakeland of The Lakes shall be dependent upon acts of God, flood, fire, warfare, government laws or regulations, electrical failure, strikes by suppliers/manpower, and or conditions beyond its control.

13. Price Amendments: Prices are valid from 1st January to 31st December each year and are subject to change without notice.

14. Refunds: Refunds are given only in exceptional circumstances as deemed appropriate by Cakeland of The Lakes.

15. Allergies: Cakeland of The Lakes shall not be held responsible for nut allergies to The Client or their parties. All cakes COULD contain traces of nut. It is The Client’s responsibility to inform their guest that traces of nut COULD be present in the cake.
16. Icing Cake service: Cakeland of The Lakes reserves the right to inspect the appearance of the cakes The Client has provided to be iced. We will not accept any cakes that are not level and of less than 3 inches deep. Cakeland of The Lakes cannot be held responsible for the quality of the cake itself or any damages it may present to the icing we have provided the service for.
